GoNerds — Terms & Conditions

These Terms & Conditions ("Terms") are a binding agreement between you and GoNerds Technologies ("GoNerds", "we", "us", "our") and govern your access to and use of the GoNerds mobile app and the gonerds.in website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
- You must be at least 18 years old to create an account and accept these Terms.
- GoNerds is a learning platform for various audiences — currently young children (ages 3–7), with K‑12 students and competitive‑exam aspirants planned. Depending on the section, a learner may be an adult or a minor (under 18).
- The account holder must be an adult (18+). You may use GoNerds as an adult learner for yourself, and/or as a parent, guardian, or teacher who creates and supervises learner profiles for others. Minors may not create their own accounts; they use the Service through a profile under an adult's account and supervision.
- By creating a profile for a minor, you confirm that you are that minor's parent or legal guardian, or are otherwise authorised to consent to and supervise their use. Under India's DPDP Act every user under 18 is treated as a child, and you provide the parental consent required for their use.
- If you accept these Terms on behalf of a school or organisation, you represent that you have authority to bind it.
2. The Service and your licence to use it
Subject to these Terms, we grant you a limited, personal, non‑exclusive, non‑transferable, non‑sublicensable, revocable licence to download and use the Service for your and your Children's personal, non‑commercial educational use.
You may not, and must not allow anyone to: copy, modify, distribute, sell, rent, or lease the Service; reverse‑engineer, decompile, or attempt to extract source code (except to the limited extent applicable law prohibits this restriction); remove or alter any proprietary notices; or use the Service other than as permitted by these Terms and our Acceptable Use Policy.
3. Your account
- You agree to provide accurate information and to keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity under your account, including all use by your Children.
- Notify us promptly at support@gonerds.in of any unauthorised use or security breach.
- You may use "Sign in with Google"; your use of Google's services is subject to Google's terms.
4. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy (AUP), which is incorporated into these Terms by reference. The AUP prohibits, among other things, illegal, harmful, infringing, or abusive activity and any attempt to disrupt or gain unauthorised access to the Service.
5. Advertising
The Service may be supported by advertising. Because the Service is directed to children, any ads are contextual and non‑personalised and are served in accordance with our Privacy Policy. We do not endorse advertised products, and your dealings with advertisers are solely between you and them.
6. Fees, subscriptions, and purchases
The Service is currently provided free of charge. If we introduce paid features, subscriptions, or in‑app purchases in the future, the applicable prices and terms will be presented to you before you buy, billing will generally be handled by the Apple App Store or Google Play, and their purchase, auto‑renewal, and refund rules will apply in addition to these Terms.
7. Intellectual property
The Service, including all software, content, text, graphics, characters (such as the GoNerds owl), logos, designs, and trademarks, is owned by GoNerds or its licensors and is protected by intellectual‑property laws. Except for the licence in Section 2, no rights are granted to you. "GoNerds" and our logos are our trademarks; you may not use them without our prior written permission.
8. Your feedback
If you send us ideas, suggestions, or feedback ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty‑free licence to use, reproduce, modify, and incorporate the Feedback for any purpose, without obligation or compensation to you. Please do not include personal or confidential information in Feedback.
9. Third‑party services and app stores
The Service relies on third parties (for example, Google sign‑in, AWS hosting, app‑store distribution, and our ad partner). Your use of those services may be subject to their own terms, and we are not responsible for them. Where you obtain the app through the Apple App Store or Google Play, you also agree to that store's terms, and you acknowledge that the store is not responsible for the Service or for support.
10. Privacy
Our Privacy Policy explains how we handle personal data, including children's data. By using the Service, you acknowledge that we process data as described there.
11. Suspension and termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms or the AUP, if required by law, or to protect the Service or other users.
- On termination, the licence in Section 2 ends and you must stop using the Service. Sections that by their nature should survive (including Sections 7, 8, 12–16) will survive.
12. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, error‑free, or free of harmful components, or that any educational outcome will be achieved. The Service is an educational aid and is not a substitute for professional educational, medical, or psychological advice.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law (including mandatory consumer‑protection rights you may have in your country of residence).
13. Limitation of liability
To the fullest extent permitted by law:
- GoNerds, its affiliates, and their officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the Service, even if advised of the possibility of such damages.
- Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) INR 10,000.
These limitations do not apply to liability that cannot be limited under applicable law, such as liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, you may have rights under mandatory local law that these Terms do not affect.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless GoNerds and its affiliates, and their officers, employees, and agents, from and against any claims, liabilities, damages, losses, and reasonable expenses (including reasonable legal fees) arising out of or related to: (a) your or your Children's use of the Service; (b) your breach of these Terms or the AUP; (c) your violation of any law or of any third‑party right; or (d) content or information you submit. We will notify you of any such claim and may, at our option, control its defence; you agree to cooperate reasonably.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict‑of‑laws rules. Subject to the paragraph below, the courts at Bengaluru, India will have exclusive jurisdiction, and you consent to that jurisdiction and venue. If you are a consumer resident in the EU/UK or another jurisdiction whose law guarantees you the right to bring claims locally or to benefit from mandatory local consumer protections, nothing in this Section deprives you of those rights.
16. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will update the "Last updated" date and, where appropriate, give notice in‑app or by email. Your continued use of the Service after the change takes effect means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
17. General
- Entire agreement. These Terms, the AUP, and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Severability. If any provision is found unenforceable, the rest remains in effect and the unenforceable provision will be modified to the minimum extent necessary.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may give notices via the app, email, or our website. You may contact us at support@gonerds.in.
